2. FMCSA Begins Two-Phase Implementation of Informal Hearing Process for its "Rules of Practice"

The Federal Motor Carrier Safety Administration (FMCSA) has issued notice that it is implementing, in two phases, a new informal hearing process for civil penalty proceedings provided for in its final rule revising 49 CFR Part 386, "Rules of Practice for Motor Carrier, Broker, Freight Forwarder, and Hazardous Materials Proceedings," that became effective on November 14, 2005. The first phase began March 17, 2006 for its Midwest Service Center geographic area, and the second phase of nationwide implementation will begin by November 14, 2006. 3. DHS' National Security TAC to Hold Partially Open Meeting on May 10th

The Department of Homeland Security (DHS) has announced a partially open meeting of its National Security Technical Advisory Committee (NSTAC) on May 10, 2006 in Washington, DC. NSTAC advises the President on issues and problems related to implementing national security and emergency telecommunications policy. 4. Army Announces Availability for Licensing of Footwear-Related Patent

The Department of the Army has issued a notice announcing the availability for licensing of U.S. Patent No. US 7,0011,781 B2 entitled "Method of Producing an Article of Footwear with Temperature Regulation Means" issued March 14, 2006. According to the notice, this patent has been assigned to the U.S. government as represented by the Secretary of the Army. 5. AMS Final Rule Amends Voluntary Shell Egg Grading and Inspection

The Agricultural Marketing Service (AMS) has issued a final rule, effective April 12, 2006, which amends the regulations governing the voluntary shell egg grading program and the regulations governing the inspection of eggs. Among other things, the final rule revises the definition of washed ungraded eggs. 6. BIS Seeks Comments on Impact of DPAS Set-Aside for Metal-Working Machines

The Bureau of Industry and Security (BIS) has issued a notice of inquiry which seeks comments on the impact of the Defense Priorities and Allocations System (DPAS) set-aside for metal working machines on industry (15 CFR 700.31). BIS explains that its notice of inquiry is part of an effort to collect information to assist in the preparation of revisions to the DPAS regulations (15 CFR Part 700), including the possible elimination of the metalworking machines set-aside. 7. BIS Corrects Final Rule Revising the Formula for Calculating Computer Performance

The Bureau of Industry and Security (BIS) has issued a notice, effective May 2, 2006, which corrects four errors that appeared in its April 24, 2006 final rule which implemented a new formula for computer performance as agreed to by the Wassenaar Arrangement, moved Bulgaria from Computer Tier 3 to Computer Tier 1, and made other related technical changes.
