U.S. Customs and Border Protection (CBP) has issued its weekly quota commodity report as of January 3, 2006. This report includes tariff-rate quotas (TRQs) on various products such as beef, tuna, sugar, dairy products, peanuts, cotton, cocoa powder, tobacco, certain JFTA, MFTA, NAFTA, SFTA, UAFTA and UCFTA TRQs, etc. This report also includes the AGOA, ATPDEA, CBTPA, MFTA, NAFTA, SFTA, and UCFTA (CFTA) tariff preference levels (TPLs) for qualifying apparel and/or other textile articles, the TRQs on worsted wool fabrics, etc. (CBP's weekly quota commodity report, dated 01/03/06, available at http://www.cbp.gov/xp/cgov/import/textiles_and_quotas/commodity/)

1. Weekly Quota Commodity Report as of January 3, 2006

2. Preliminary Restraint Limit for Tuna Exceeded at Opening on Jan 3, 2006
CBP has posted a notice to its Web site announcing that the tariff rate quota (TRQ) for tuna, which opened on January 3, 2006, exceeded the preliminary restraint limit at the opening. All entries presented at the over-quota (high) rate since the opening have been charged and may be released. CBP states that it will be provided the final quota limit in March 2006. Upon receipt of the final quota limit, CBP will issue proration and liquidation instructions to the field/trade. Entries should continue to be submitted at the over-quota (high) rate. If a warehouse entry is liquidated prior to receipt of the final restraint limit, CBP recommends that the importer file a protest to ensure proper processing of any applicable refund once the final proration is determined. 3. Israel Butter TRQ Oversubscribed at Opening Moment on Jan 3, 2006
CBP has posted to its Web site a notice announcing that the TRQ on butter from Israel that opened on January 3, 2006 oversubscribed at opening moment. The pro rata percentage is 45.04% or .4504.
CBP states that entries or warehouse withdrawals for consumption covering merchandise subject to the above TRQ and presented after opening should be returned to the broker. The importer has the option to determine how its allocation will be distributed, i.e., more or less than the pro rata amount (or none) on a given entry. The importer may also transfer its allotment to entries at another port. Any of these scenarios are acceptable, however no importer will be allowed to enter quantities in excess of the prorated amount properly presented at opening. 4. NAFTA TRQ on Mexico Peanuts Did Not Oversubscribe at Opening
CBP has posted to its Web site a notice announcing that the NAFTA TRQ on Mexico Peanuts in HTS Chapter 99, Subchapter VI, U.S. Note 16, which opened on January 3, 2006, did not oversubscribe at the opening. Therefore, all entries presented at opening have been charged and may be released. 5. CBP Customer Service Phones Temporarily Out of Order
CBP has posted a notice on its Web site announcing that it is currently experiencing technical difficulties with its phone servers for its Customer Service Phones at 202-354-1000 or 1-877-CBP-5511. CBP states that those requiring assistance from CBP's Customer Service Center should send CBP an email through its Questions and Answers page.
