AD: Germany, Turkey, and China Carbon and Certain Alloy Steel Wire Rod

The International Trade Administration (ITA) has initiated antidumping (AD) duty investigations on carbon and certain alloy steel wire rod from Germany, Turkey, and China.

Antidumping Duty Investigations Initiated

Scope of the Investigations: The merchandise subject to this scope is certain hot rolled products of carbon steel and alloy steel, in coils, of approximately circular cross section, 4.75 mm or more, but less than 19.00 mm, in solid cross-sectional diameter.

All products meeting the physical description of subject merchandise that are not specifically excluded are included in this scope.

HTS Subheadings for the Investigations: The products under review are currently classifiable under subheadings 7213.91.3011, 7213.91.3015, 7213.91.3092, 7213.91.4500, 7213.91.6000, 7213.99.0030, 7213.99.0090, 7227.20.0000, and 7227.90.6050.

Although the HTS subheadings are provided for convenience and U.S. Customs and Border Protection (CBP) purposes, the written description of the scope of this proceeding is dispositive.

Exclusions from the Scope of the Investigations: Specifically excluded from the scope are steel products possessing the above-noted physical characteristics and meeting the HTS definitions for (a) stainless steel; (b) tool steel; (c) high nickel steel; (d) ball bearing steel; and (e) concrete reinforcing bars. Also excluded are free machining steel products (i.e., products that contain by weight one or more of the following elements: 0.03 percent or more of lead, 0.05 percent or more of bismuth, 0.08 percent or more of sulfur, more than 0.04 percent of phosphorus, more than 0.05 percent of selenium, or more than 0.01 percent of tellurium).

Separate rate status for subject merchandise from China. The ITA states it is now publicizing its requirement that for a non-market economy (NME), China in this case, responses must be submitted for both the quantity and value questionnaire and the separate-rates application by their respective deadlines in order to receive consideration for separate rate status.

The ITA states that this new procedure will be applied to all future investigations. The ITA notes that the quantity and value questionnaire for China is included as Attachment I to the ITA's initiation notice.

- comments on the scope of these investigations due within 20 days of 12/07/05

- ITA's preliminary AD duty determinations due no later than 140 days after 12/07/05

- preliminary International Trade Commission (ITC) injury determinations due within 25 days of the date on which it received notice of these petitions
