AD: China Garlic

The International Trade Administration (ITA) has issued a notice that amends the final results of its antidumping (AD) duty administrative review of garlic from China for the period of November 1, 2002 through October 31, 2003.

Amended Final Results of AD Duty Administrative Rev

The ITA states that these amendments are being made in order to correct certain ministerial errors made in the AD duty final determination calculations for Harmoni, Jinan Yipin, Linshu Dading, FHTK, and Ziyang, as well as certain ministerial errors that affected the ITA's margin calculation in the final results.

The ITA states that these and other companies filed complaints challenging the final results of the administrative review with the Court of International Trade (CIT). The ITA explains that when these complaints were filed with the CIT, the ITA no longer had jurisdiction to correct ministerial errors. On September 15, 2005, the CIT granted the ITA's request for leave to correct the ministerial errors.

For shipments with a time of entry on or after September 28, 2005, the ITA has issued the following amended AD cash deposit instructions:

Assessment Instructions for the Review Period (11/01/02 - 10/31/03)

The ITA states that it will issue appropriate assessment instructions directly to U.S. Customs and Border Protection (CBP) within 15 days of September 28, 2005, where injunctions are not in place.
