The Journal of Commerce (JoC) has reported that the terminals of Los Angeles/Long Beach are exempt from the Lowenthal Law, a California law that fines terminal operators $250 every time a truck has to wait more than 30 minutes to enter a marine terminal. According to JoC, when the PierPass program was launched on July 23, 2005, all international container terminals in the port complex became open more than 70 hours per week, which exempts them from the fine. 2. EU May Reopen WTO Dispute Over the FSC/ETI

TheWall Street Journal reports that the European Union (EU) may reopen the Foreign Sales Corporation/Extraterritorial Income (FSC/ETI) dispute with the U.S. as the World Trade Organization (WTO) has found that the U.S. failed in its attempt to end these tax breaks granted to its exporters. The WTO was reportedly concerned with certain transition periods provided for in the U.S.' regulation repealing the FSC/ETI. 3. Nicaraguan Congress Postpones its Debate on DR-NAFTA

Washington Trade Daily reports that the Nicaraguan Congress has postponed until next month debate on the proposed free trade agreement between Central America and the U.S. (DR-CAFTA). Supporters of the free trade agreement state that debate was delayed because of pressure from the Sandinistas, whose party, along with dissenting members of Nicaragua's ruling Constitutionalist Liberal Party, oppose the measure. 4. U.S. - China Textile Talks Slated for Next Week

According to The Washington Post, U.S. and Chinese officials will hold textile trade talks on the China safeguard quotas and related issues next week in San Francisco. In addition, the Office of the U.S. Trade Representative (USTR) stated on August 9, 2005 that the Bush Administration has not yet decided whether to formally seek a comprehensive textile trade deal with Beijing. 5. CITA Notice on Pending "Actual" Market Disruption Proceedings for China 340/640, 638/639, and 647/648

The Committee for the Implementation of Textile Agreements (CITA) has issued a notice stating that at this time there is no need for further action on its China Safeguard proceedings for categories 340/640, 638/639 and 647/648 that are based on "actual" market disruption, as it has already imposed safeguard quotas on these categories based on "threat" of market disruption. (Note that the China safeguard quotas on 638/639 and 647/648 are closed, and the China safeguard quota on 340/640 is expected to close soon.) 6. State Dept Statutory Debarment of Three Persons Under ITAR

The State Department has issued notice that it has imposed statutory debarment for a minimum three year period (following the date of conviction) on the following persons who have been convicted of violating or conspiring to violate Section 38 of the Arms Export Control Act (AECA) on the listed dates: Mexpar International, Inc. a/k/a "Pasadena Aerospace" and "Aviation Logistics and Supply" (07/30/04); Ahmad Naharadani a/k/a "Alex Nahardani," (08/09/04); and Gabriela de Brea a/k/a "Gabriela Brea" and "Gabriela Lopez-Sosa" (09/10/04). Debarred persons are generally ineligible to participate in activity regulated under the ITAR (International Traffic in Arms Regulations), among other things.
