AD: India Stainless Steel Flanges

The International Trade Administration (ITA) has issued the final results of the antidumping (AD) duty administrative review of stainless steel flanges from India for the period of February 1, 2003 through January 31, 2004.

Final Results of AD Duty Administrative Review

Revocation of AD Duty Order for Viraj

The ITA has determined that Viraj Forgings, Ltd. (Viraj) qualifies for revocation of the AD duty order on stainless steel flanges from India. As a result, this AD duty order will be revoked with respect to subject merchandise exported and produced by Viraj.

As a result, the ITA is terminating suspension of liquidation for any of the subject merchandise that is produced and exported by Viraj with a time of entry on or after February 1, 2004. The ITA adds that it will instruct U.S. Customs and Border Protection (CBP) to refund any AD cash deposits for such entries.

AD Cash Deposit Instructions for a Time of Entry On/After 07/12/05:

Echjay Forgings Pvt., Ltd. (Echjay)

(a) With respect to Viraj and Echjay, the ITA has found that de minimis duty rates of 0.01% (Viraj) and 0.03% (Echjay) exist. As noted above, the AD duty order is being revoked for Viraj, effective February 1, 2004. For Echjay, no AD duty cash deposit is required, but liquidation will remain suspended

(b) For previously reviewed or investigated companies not listed above, the cash deposit will continue to be the company-specific rate published for the most recent period;

(c) If the exporter is not a firm covered in this review, a prior review, or the original investigation, but the manufacturer is, the cash deposit rate will be that established for the most recent period for the manufacturer of the merchandise; and

(d) If neither the exporter nor the manufacturer is a firm covered in this review, any previous reviews, or the AD duty investigation, the cash deposit rate will be 162.14%, the "all others" rate established in the AD duty investigation.

Assessment Instructions for the Review Period (02/01/03 - 01/31/04)

The ITA states that it will issue appropriate assessment instructions directly to CBP within 15 days of July 12, 2005.

The ITA also states that the AD duty assessment rate is importer-specific, and according to trade sources, may differ significantly from the AD cash deposit rates listed above.
