AD: Canada Certain Softwood Lumber Products and China Brake Rotors

The International Trade Administration (ITA) has issued its preliminary results of two antidumping (AD) changed circumstances reviews of (1) certain softwood lumber products from Canada, and (2) brake rotors from China.

Preliminary Results of AD Duty Changed Circumstances Reviews

These preliminary results are not in effect and the current requirements for a cash deposit of estimated AD duties on subject merchandise will continue unless and until these requirements are modified pursuant to the final results of these AD duty changed circumstances reviews.

Certain softwood lumber products from Canada. With respect to certain softwood lumber products from Canada, the ITA preliminarily concludes that Winton Global Lumber Ltd. (Winton Global) is the successor-in-interest to The Pas Lumber Company Ltd. (Pas), and if these preliminary results are made final, Winton Global would be entitled to receive the same AD duty cash deposit rate (1.83%) with respect to the subject merchandise as Pas.

The ITA's notice also serves as the initiation notice for this AD duty changed circumstances review.

The ITA states that it will issue the final results of this AD duty changed circumstances review no later than 270 days after the date on which this review was initiated (i.e. May 9, 2005) or within 45 days if all parties agree to the ITA's preliminary finding.

Brake rotors from China. With respect to brake rotors from China, the ITA preliminarily concludes that Shanxi Fengkun Foundry Ltd., Co. (Fengkun Foundry) is not the successor-in-interest to Shanxi Fengkun Metallurgical Ltd., Co. (Fengkun Metallurgical), and if these preliminary results are made final, Fengkun Foundry would not be entitled to receive the same AD duty treatment with respect to brake rotors as the former entity Fengkun Metallurgical1. Instead, Fengkun Foundry would receive the China-wide rate (43.32%).

The ITA will issue the final results of this AD duty changed circumstances review not later than July 11, 2005 (which is 270 days after the date on which this review was initiated).

Although the current AD duty cash deposit rate listed in U.S. Customs and Border Protection's (CBP's) AD/Countervailing (CV) query for subject merchandise from Fengkun Metallurgical is zero percent, if these preliminary results are made final, the ITA states that Fengkun Metallurgical would be subject to the China-wide rate (43.32%) as it no longer exists as a legal entity in China.
