ITA Initiates Review of Ukraine's AD Non-Market Economy Status

The International Trade Administration (ITA) has initiated an antidumping (AD) duty changed circumstances review in order to examine whether Ukraine is still a non-market economy (NME) country for purposes of the AD duty law.

According to the ITA, on April 2, 2005 the Government of Ukraine's Ministry of Economy and European Integration requested that the ITA conduct a review of Ukraine's status as an NME country within the context of a changed circumstances review of the AD duty order on carbon and certain alloy steel wire rod from Ukraine (A-823-812).

ITA Resumes 2002 Ukraine NME Status Review in Which it Deferred Decision

As a result, the ITA is initiating a changed circumstances review of the AD duty order on carbon and certain alloy steel wire rod from Ukraine in order to examine whether Ukraine is still an NME country for purposes of the AD duty law. Specifically, the ITA is resuming the review of Ukraine's NME status on which it deferred a decision in August 2002. ITA Seeks Public Comments and May Schedule Public Hearing

The ITA states that it is interested in receiving public comment with respect to Ukraine in relation certain listed factors, which it must take into account in making a market/NME determination.

The ITA states that initial comments are due within 45 days of April 26, 2005 and rebuttal comments may be submitted up to 30 days after the date by which initial comments are due.

The ITA states that, after reviewing all comments and rebuttal comments, it will hold a public hearing on the NME country issue if one is requested in the initial or rebuttal comments on this issue by an interested party, as defined in section 771(9) of the Tariff Act of 1930, or if the ITA determines that one is warranted.
