ITA Extends Steel Import Monitoring Through March 21, 2009 (Part I - Products Added/Dropped from Licensing)

Effective Dates for ITA Interim Final Rule, Licensing, & Termination of Licensing

This interim final rule is effective March 11, 2005 and licensing will continue without interruption for those products currently subject to steel import licensing (listed in Annex I of the interim final rule). With respect to newly covered steel products (Annex II), licensing will be implemented on June 9, 2005. Likewise, termination of licensing for those products being removed from SIMA monitoring (Annex III) will not occur until June 9, 2005.

The ITA notes that it intends to issue a final rule responding to comments received on this interim rule before September 30, 2005.

(The ITA explains that the purpose of the SIMA system is to collect timely detailed statistics on anticipated steel imports and to provide stakeholders with information about import trends in this sector. The ITA further explains that the SIMA system aggregates detailed import statistics it collects from internet-generated licenses and makes the data available for public analysis on a weekly basis.)

Part I focuses on the products that will remain subject to SIMA coverage and licensing requirements, as well as those products that are added or removed from such coverage and requirements. Products To Be Removed From SIMA (Annex III)

The ITA's interim final rule terminates licensing with respect to certain downstream steel products now covered, specifically, carbon and alloy flanges and pipe fittings, effective June 9, 2005. The affected HTS numbers are: 7307915010, 7307915030, 7307915050, 7307915070, 7307923010, 7307923030, 7307929000, 7307933000, 7307936000, 7307939030, 7307939060, 7307995015, 7307995045, 7307995060.

(On December 31, 2002, the ITA published a final rule that established SIMA in connection with the implementation of Section 201 steel safeguard measures imposed in March 2002. On December 4, 2003, President Bush issued Proclamation 7741 that terminated those Section 201 steel safeguard measures, but directed the Secretary of Commerce to continue SIMA until the earlier of March 21, 2005 or such time as the Secretary of Commerce establishes a replacement program. On December 9, 2003, the ITA announced that although the Section 201 steel safeguard measures had been terminated, SIMA would continue.)
