CV: Thailand Certain Hot-Rolled Carbon Steel Flat Products
The International Trade Administration (ITA) has published a notice in the Federal Register stating that on October 1, 2004 the Court of International Trade (CIT) issued an order sustaining the ITA's final results of redetermination on remand with respect certain hot-rolled carbon steel flat products from Thailand.

In its redetermination results, the ITA found, as ordered by the CIT, that the challenged duty drawback program at issue is not countervailable. The ITA states that the effect of this finding is the reduction of the overall countervailable subsidy rate for subject merchandise from Thailand to a de minimis level of 1.80%.
Suspension of Liquidation to Continue Pending Expiration of Appeal Period, Etc.
The ITA states that this notice will serve to continue the suspension of liquidation pending the expiration of the period to appeal the CIT's October 1, 2004 decision, or if that decision is appealed, pending a final decision by the Court of Appeals for the Federal Circuit (CAFC).
The ITA also states that because the CIT issued an injunction on May 19, 2004, the ITA will continue to suspend entries of subject merchandise from Thailand as specified in the injunction.
ITA to Revoke Order if CIT's Decision is Not Appealed or if Affirmed on Appeal
According to the ITA, it will revoke the countervailing (CV) duty order and issue instructions covering these entries if the CIT's decision is not appealed or if it is affirmed on appeal.
