CITA Denies CBTPA "Commercial Availability" Petition for Certain Yarns Used in Chief Weight Cotton Sweaters

The Committee for the Implementation of Textile Agreements (CITA) has published a notice denying a petition submitted on behalf of Bernette Textile Co., LLC. of New York, NY that had alleged that certain colored open end spun yarns, classified in HTS 5206.11.0000 and 5206.12.0000, of certain specifications and ranging in size from 6/1 to 18/1 English count (10.16/1 to 30.47/1 metric) of a blend of reclaimed and reprocessed cotton and acrylic staple fiber, could not be supplied by the domestic industry in commercial quantities in a timely manner.

The petitioner had requested quota- and duty-free treatment under the U.S.-Caribbean Basin Trade Partnership Act (CBTPA) for chief weight cotton sweaters that are made in one or more CBTPA beneficiary countries from such yarns.

CITA Determines Such Yarns Can Be Timely Supplied by the Domestic Industry

Based on currently available information and its review, CITA states that it has determined that there is domestic capacity to supply the subject yarns in commercial quantities in a timely manner.

According to CITA, the specifications are as follows: (i) description: open end spun yarn of uncombed fibers, (ii) size: 10 to 31 metric count, and (iii) fiber content: in chief weight of cotton reclaimed from fabric scraps blended with producer dyed acrylic staple produced under license from Outlast Technologies, Inc.
