CITA Denies Three CBTPA "Commercial Availability" Petitions for Certain Woven Fabrics

The Committee for the Implementation of Textile Agreements (CITA) has published a notice denying three petitions submitted on behalf of Fishman & Tobin which had alleged that certain woven fabrics described as: (1) twill fabric classified in HTS 5208.33.00.00 and 5209.32.00.20, (2) fancy polyester filament fabric classified in HTS 5407.52.20.20, 5407.52.20.60, 5407.53.20.20, and 5407.53.20.60, and (3) 190T polyester lining fabric classified in HTS 5407.61.99.25-35 could not be supplied by the domestic industry in commercial quantities in a timely manner.

The petitioners had requested quota- and duty-free treatment under the U.S.-Caribbean Basin Trade Partnership Act (CBTPA) for apparel articles that are both cut and sewn in one or more CBTPA beneficiary countries from such fabrics.

CITA Determines Fabrics Can be Supplied by the Domestic Industry as Required

Based on currently available information, CITA states that it has determined that such fabrics can be supplied by the domestic industry in commercial quantities in a timely manner.

a fourth petition for fancy polyester/rayon blend suiting fabric classified in HTS 5515.11.0005 was subsequently withdrawn.
