AD: Korea & Mexico Certain Circular Welded Carbon-Quality Line Pipe

The International Trade Administration (ITA) has made preliminary affirmative antidumping (AD) duty determinations that certain circular welded carbon-quality line pipe from Korea and Mexico is being, or is likely to be, sold in the U.S. at less than fair value.

As a result, the ITA will instruct U.S. Customs and Border Protection (CBP) to suspend liquidation (except for SeAH from Korea) for all entries of subject merchandise with a time of entry on or after October 6, 2004.

At the same time, the ITA states that it is instructing CBP to require a cash deposit or posting of a bond (except for SeAH from Korea) at the AD rate (equal to the weighted-average margin) listed below, for entries of subject merchandise with a time of entry on or after October 6, 2004:

The ITA has determined that HYSCO is now a mandatory respondent (rather than

Hyundai Corporation).

(a) a preliminary de minimis rate of 1.19%. According to ITA sources, instructions to

CBP will indicate that SeAH is preliminarily excluded from suspension of liquidation

and AD bond/cash deposit requirements.

Final AD Duty Determinations Postponed

The ITA states that as a result of requests from certain respondents in these AD duty investigations, it has postponed the due date for these final determinations until not later than 135 days after October 6, 2004 and have extended provisional measures accordingly.

ITA Amends Scope of the Investigations

The ITA has amended the scope of each of these investigations to read as follows (new text is denoted with <carrots>):

The scope of this investigation includes <certain> circular welded carbon quality steel <line> pipe of a kind used in oil and gas pipelines, <over 32 mm (1 inches) in nominal diameter (1.660 inch actual outside diameter) and> not more than 406.4 mm (16 inches) in outside diameter, regardless of wall thickness, surface finish (black, or coated with any coatings compatible with line pipe), and regardless of end finish (plain end, beveled ends for welding, threaded ends or threaded and coupled, as well as any other special end finishes), and regardless of stenciling. The merchandise subject to this investigation may be classified in the Harmonized Tariff Schedule of the United States ("HTSUS'') at heading 7306 and subheadings 7306.10.10.10, 7306.10.10.50, 7306.10.50.10, and 7306.10.50.50. The tariff classifications are provided for convenience and Customs purposes; however, the written description of the scope of the investigation is dispositive.
