AD: China Fresh Garlic

The International Trade Administration (ITA) has issued its final results of the antidumping (AD) duty new shipper review of fresh garlic from China for the period of November 1, 2002 through October 31, 2003.

As a result, the ITA states that bonding is no longer permitted to fulfill security requirements for shipments of fresh garlic from China from Shanyang with a time of entry on or after September 30, 2004.

For shipments with a time of entry on or after September 30, 2004, the ITA has determined the following AD cash deposit rate (equal to the weighted average margin percentage) listed below:

(a) For all other subject merchandise exported by Shenyang, the cash-deposit rate will be 376.67%;

(b) For all other China exporters of subject merchandise which have not been found to be entitled to a separate rate, the AD cash deposit rate will be the China-wide rate of 376.67%; and

(c) For all non-China exporters of subject merchandise, the AD cash deposit rate will be the rate applicable to the China exporter that supplied that exporter.

Assessment Instructions for the Review Period (11/01/02 - 10/31/03)

According to the ITA, it will determine and U.S. Customs and Border Protection (CBP) will assess AD duties on all appropriate entries. The ITA states that it will issue appropriate assessment instructions directly to CBP within 15 days of September 30, 2004.
