U.S. Customs and Border Protection (CBP) has posted to its Web site a notice announcing the opening of the tariff-rate quota (TRQ) on raw cane sugar as provided for in HTS Chapter 17, Additional U.S. Note (AUSN) 5 for the period October 1, 2004 through September 30, 2005. According to CBP, this TRQ opens on October 1, 2004 at 1:00 p.m. EDT or its equivalent in other time zones.

1. 2004/2005 Raw Cane Sugar TRQ Opens October 1, 2004

CBP's notice lists the country-specific TRQ allocations, as well the related HTS Chapters 17 and 99 tariff numbers. CBP states that a Certificate of Quota Eligibility (CQE) will be required with the date of the current quota period (2004/2005) for any in-quota entry presented for raw cane sugar from the specified countries and areas.

CBP further states that any country without a TRQ allocation, which is not subject to a U.S. embargo, may export raw cane sugar at the over-quota (high) rate, and is not required to furnish a CQE.

2. 2004/2005 Refined and Specialty Sugar TRQ Opens October 1, 2004

CBP has posted to its Web site a notice announcing the opening of the tariff-rate quota (TRQ) on refined and specialty sugar as provided for in HTS Chapter 17, AUSN 5 for the period October 1, 2004 through September 30, 2005.

According to CBP, this TRQ opens on October 1, 2004 at 1:00 p.m. EDT or its equivalent in other time zones, and the TRQ level is 7,090,000 kg (no CQE or Specialty Sugar Certificate required), with an additional allocation (for refined sugar) of 10,300,000 kg for Canada (no CQE required), and 2,954,000 kg for Mexico (CQE required).

CBP notes that this TRQ is expected to oversubscribe at opening moment.

CBP explains that there will four successive openings for specialty sugar, available on a first-come, first-served global basis, on October 26, 2004, November 16, 2004, March 22, 2005, and June 7, 2005 (detailed information will be published later in October 2004).

3. 2004/2005 Sugar Blends (17 AUSN 7) TRQ Opens October 1, 2004

CBP has posted to its Web site a notice announcing the opening of the tariff-rate quota (TRQ) on sugar blends as provided for in HTS Chapter 17, AUSN 7 for the period October 1, 2004 through September 30, 2005.

According to CBP, this TRQ opens on October 1, 2004 at 1:00 p.m. EDT or its equivalent in other time zones, and the TRQ level is zero. CBP states that such sugar blends must be entered at the over-quota (high) rate using the appropriate over-quota HTS tariff number.

CBP's notice lists the related HTS Chapters 17, 18, 19, 21, and 99 tariff numbers, and states that imports from Canada, Mexico, Jordan, Singapore, and Chile are not subject to HTS Chapter 99, Subchapter IV, U.S. Note 1, and should be presented as a type 02 entry using the high rate (over-quota) tariff number provided for in HTS Chapters 17, 18, 19, or 21 without the HTS Chapter 99 tariff number.

4. 2004/2005 Sugar Blends (17 AUSN 8) TRQ Opens October 1, 2004

CBP has posted to its Web site a notice announcing the opening of the tariff-rate quota (TRQ) on sugar blends as provided for in HTS Chapter 17, AUSN 8 for the period October 1, 2004 through September 30, 2005.

According to CBP, this TRQ opens on October 1, 2004 at 1:00 p.m. EDT or its equivalent in other time zones, and the TRQ level for Canada is 59,250,000 kg and 5,459,000 kg for other countries (except Mexico).

CBP notes that the "other countries" TRQ is expected to oversubscribe at opening moment.

CBP has posted to its Web site a notice announcing the opening of the tariff-rate quota (TRQ) on mixes and doughs as provided for in HTS Chapter 19, AUSN 3 for the period October 1, 2004 through September 30, 2005.

According to CBP, this TRQ opens on October 1, 2004 at 1:00 p.m. EDT or its equivalent in other time zones, and the TRQ level for all countries except Mexico is 5,398,000 kg.

CBP's notice lists the related HTS Chapters 19 and 99 tariff numbers, and states that imports from Canada, Mexico, Jordan, Singapore, or Chile are not subject to HTS Chapter 99, Subchapter IV, U.S. Note 1, and should be presented as a type 02 entry using the high rate (over-quota) tariff number provided for in HTS Chapter 19 without the HTS Chapter 99 tariff number. CBP has posted to its Web site a notice announcing the opening of the tariff-rate quota (TRQ) on mixed condiments and seasonings as provided for in HTS Chapter 21, AUSN 4 for the period October 1, 2004 through September 30, 2005.

According to CBP, this TRQ opens on October 1, 2004 at 1:00 p.m. EDT or its equivalent in other time zones, and the TRQ level for all countries except Mexico is 689,000 kg.

CBP's notice lists the related HTS Chapters 21 and 99 tariff numbers, and states that imports from Canada, Mexico, Jordan, Singapore, or Chile are not subject to HTS Chapter 99, Subchapter IV, U.S. Note 1, and should be presented as a type 02 entry using the high rate (over-quota) tariff number provided for in HTS Chapter 21 without the HTS Chapter 99 tariff number.
