AD: China Certain Tissue Paper and Crepe Paper Products
The International Trade Administration (ITA) has made preliminary affirmative antidumping (AD) duty determinations that certain tissue paper products and certain crepe paper products from China are being, or are likely to be, sold in the U.S. at less than fair value.

As a result, with respect to Fujian Naoshan and the tissue paper Section A respondents receiving a separate rate, the ITA will instruct U.S. Customs and Border Protection (CBP) to suspend liquidation for all entries of subject merchandise with a time of entry on or after September 21, 2004.
However, because of a critical circumstances finding with respect to: (1) China National, for tissue paper, (2) the crepe paper Section A respondents receiving a separate rate, and (3) the China-wide entities for tissue paper and crepe paper, the ITA will direct CBP to suspend liquidation of all entries of certain tissue paper products and certain crepe paper products from China with a time of entry on or after 90 days prior to September 21, 2004.
The ITA states that it is also instructing CBP to require a cash deposit or the posting of a bond at the AD rate (equal to the weighted-average margin) listed below, for entries of subject merchandise with a time of entry on or after September 21, 2004.

Section A respondents are companies who were not selected as mandatory respondents but submitted responses to Section A of the ITA's AD questionnaire and had sales of subject merchandise to the U.S. during the period of investigation (see below for list of these respondents).
Due Dates for Final AD Duty Determinations
The ITA states that it will make its final AD duty determination for certain crepe paper products from China no later than 75 days after September 21, 2004. However, the ITA is postponing the final AD duty determination for certain tissue paper products until no later than 135 days after September 21, 2004, and is extending suspension of liquidation until no longer than six months.
ITA Amends Scope of Investigation
The ITA's notice of preliminary affirmative AD duty determinations contains certain changes to the scope of investigation as it was published in the ITA's initiation notice. In addition to certain minor editorial changes, for tissue paper products, the following HTS numbers were added: 4820.50.00; 4802.90.00; and 4805.91.90.
With regard to crepe paper products, HTS 4818.90 is added. In the paragraph directly preceding the list of HTS subheadings, the following phrase is also removed: "and appear to be imported under one of several different "basket categories," including but not necessarily limited to the following subheadings." In place of the removed phrase, the following sentence is added: "Subject merchandise may be under one or more of several different subheadings, including."
