Tanzania is Eligible for AGOA Duty-Free Treatment on Certain Handloomed Fabrics/Articles, Etc. and Certain Folklore Articles

The Committee for the Implementation of Textile Agreements (CITA) has issued a notice stating that, effective September 13, 2004, certain textile and apparel articles from Tanzania are eligible for duty-free treatment under the "handloomed, handmade, and folklore articles" provision of the African Growth and Opportunity Act (AGOA).

Eligible Articles Must be Produced in and Exported from Tanzania

CITA explains that it has consulted with Tanzanian officials and determined that the following items are eligible for duty-free treatment under AGOA if produced in and exported from Tanzania:

handloomed fabrics, handloomed articles (e.g. handloomed rugs, scarves, place mats, and tablecloths), as well as handmade articles made from handloomed fabrics, if made in Tanzania from fabric handloomed in Tanzania; and

three folklore articles described in the Annex to CITA's notice as a body wrap or scarf known as a mgolole , a traditional kikoi shirt, and a traditional long tunic known as a kikoi boubou. See Annex for folklore article requirements (i.e. no modern features such as zippers, patterns must be traditional/historical to Tanzania, etc.)

AGOA Visa Grouping 9 Needed to Receive Duty-Free Treatment

As a result of its determination, CITA has directed U.S. Customs and Border Protection (CBP) to allow duty-free entry of the above-described items produced in and exported from Tanzania under HTS 9819.11.27 if accompanied by an appropriate export visa in Grouping 9.

(CITA has previously explained that AGOA provides duty-free treatment for imports of the above handloomed, handmade, or folklore articles, if agreed to by the U.S. and the listed beneficiary country, and if they are certified as such by the competent authority in the listed beneficiary country. In addition, Executive Order (EO) 13191 authorizes CITA to consult with listed beneficiary countries and to determine which, if any, particular textile and apparel goods shall be treated as being handloomed, handmade, or folklore articles.)
