CBP Issues Updated Instructions on the Short Supply Designation for Certain Ring Spun Yarn for Use in Women's & Girls' Blouses, Shirts, Lingerie, & Underwear under AGOA, CBTPA, & ATPDEA

U.S. Customs and Border Protection (CBP) has issued a notice which supercedes a previous notice regarding the Committee for the Implementation of Textile Agreement's (CITA's) designation that certain ring spun micro modal/pima cotton yarn for use in women's and girls' knit blouses, shirts, lingerie and underwear is in short supply (i.e., "commercially unavailable") under the African Growth and Opportunity Act (AGOA), the U.S.-Caribbean Basin Trade Partnership Act (CBTPA), and the Andean Trade Promotion and Drug Eradication Act (ATPDEA).

New instructions to broadly apply designation to women's/girls' knit blouses and shirts. In addition to a reiteration of the information contained in the previous notice, the new notice contains an additional paragraph which states that CBP ports of entry are instructed to broadly apply the designation to women's and girls' knit blouses and shirts. CBP states that if the apparel product is classified in the HTS as a knit blouse or shirt or is identified by textile category 639 as a knit blouse or shirt, the short supply yarn named above may be used if all other requirements have been satisfied.
