AD: China Fresh Garlic

The ITA states that it is rescinding Tancheng from the AD duty new shipper review because Tancheng withdrew its request for review and no other party objected to its withdrawal of that request.

Bonding Is No Longer Permitted (AD Cash Deposit Rate Reinstated)

As a result of this rescission, the ITA states that bonding (in lieu of a cash deposit) is no longer permitted to fulfill AD security requirements for shipments of fresh garlic from China both exported and produced by Tancheng that have a time of entry on or after April 28, 2004.

The China-wide AD duty rate of 376.67% in effect at time of entry will apply to fresh garlic from China exported and produced by Tancheng during the review period; 376.67% shall also be the AD cash deposit rate for subject entries with a time of entry on and after April 28, 2004.

Assessment Instructions for the Review Period (11/01/02 - 04/30/03)

According to the ITA, within 15 days of April 28, 2004, assessment instructions for the review period will be issued to U.S. Customs and Border Protection (CBP).
