CITA Designates Certain Fabrics Used in the Production of Women's and Girls' Blouses as "Commercially Unavailable" under the CBTPA

The Committee for the Implementation of Textile Agreements (CITA) has issued two notices containing its determinations that, effective April 23, 2004, certain woven fabrics classified in HTS 5210.11 and in HTS 5513.11 and 5513.21, used in the production of women's and girls' blouses, cannot be supplied by the domestic industry in commercial quantities in a timely manner under the U.S.-Caribbean Basin Trade Partnership Act (CBTPA).

Accordingly, CITA is designating as eligible to enter free of quotas and duties under HTS 9820.11.27 women's and girls' blouses, that are both cut and sewn or otherwise assembled in one or more eligible beneficiary CBTPA countries, from these woven fabrics, provided that all other fabrics are wholly formed in the U.S. from yarns wholly formed in the U.S., including fabrics not formed from yarns, if such fabrics are classifiable under HTS 5602 or 5603 and are wholly formed in the U.S.

According to CITA, the woven fabrics that are designated as commercially unavailable are not of square construction, containing more than 70 warp ends and filling picks per square centimeter, of average yarn number exceeding 70 metric. These woven fabrics are classified under HTS 5210.11 (chief weight but less than 85% unbleached cotton, etc.), HTS 5513.11 (chief weight but less than 85% unbleached or bleached polyester staple fibers, etc.), and HTS 5513.21 (chief weight but less than 85% dyed polyester staple fibers, etc.).
