Final Results of AD Duty Administrative Review South Korea Stainless Steel Wire Rod A-580-829

The International Trade Administration (ITA) has issued its final results of the antidumping (AD) duty administrative review of stainless steel wire rod from South Korea for the review period of September 1, 2001 through August 31, 2002.

Final Results of AD Duty Administrative Review

For entries on or after April 12, 2004, suspension of liquidation will continue for the affected companies at the AD cash deposit rate below:

The ITA states that for purposes of this AD duty administrative review, it has collapsed Changwon, Dongbang and POSCO into a single entity.

(a) For previously reviewed or investigated companies not listed above, the cash deposit rate will continue to be the company-specific rate published for the most recent period.

(b) If the exporter is not a firm covered in this review, a prior review, or the original investigation, but the manufacturer is, the cash deposit rate will be the rate established for the most recent period for the manufacturer of the merchandise.

(c) The cash deposit rate for all other manufacturers or exporters will continue to be the rate of 5.77%, which is the "all others" rate established in the original investigation.

ITA Determines Not to Deduct Section 201 Duties from U.S. Prices in Calculating AD Duty Rates

The ITA states that after considering comments received, it has determined not to deduct section 201 duties from U.S. prices in calculating AD duty rates. (See ITT's Online Archives or 09/11/03 news, 03091120 for BP summary of the ITA's request for comments on the treatment of section 201 duties.)

Assessment Instructions for the Review Period (09/01/01 - 08/31/02)

According to the ITA, it will determine, and U.S. Customs and Border Protection (CBP) will assess, AD duties on all appropriate entries.

The ITA states that it has calculated an importer (or where necessary, customer)-specific assessment rate for merchandise subject to this review.

The ITA also states that it will issue appraisement instructions directly to CBP within 15 days of April 12, 2004.
