USTR Issues Certain Technical Corrections to the Harmonized Tariff Schedule

The Office of the U.S. Trade Representative (USTR) has issued a notice in order to make several technical corrections to the Harmonized Tariff Schedule of the U.S. (HTS). According to the USTR, these modifications correct inadvertent omissions or errors in various Presidential Proclamations.

The technical corrections to the HTS are as follows:

Rates of Duty for Commingled Goods. Effective with respect to goods entered or withdrawn from warehouse for consumption on or after January 1, 2004, the USTR is correcting HTS General Note 3(f)(i) on the rates of duty for certain commingled goods, by deleting the cite of "subparagraph (b)" and in its place adding the cite of "subdivision (f)(ii)".

Certain HTS number and country combinations removed from GSP List 4(d). Effective with respect to goods entered or withdrawn from warehouse for consumption on or after January 1, 2004, the USTR is amending General Note 4(d) by deleting the following subheadings and the country or countries set out opposite of each:

(USTR sources note that these HTS number/country combinations are being deleted from the General Note 4(d) list as the General Column 1 rate of duty for these tariff numbers is now 'free.')

General Note 25(o) for Singapore FTA. Effective with respect to goods that are entered or withdrawn from warehouse for consumption on or after January 1, 2004, Singapore Free Trade Agreement (FTA) Tariff Classification Rule (TCR) 1 for Chapter 62, in General Note 25(o), is modified by inserting the cite "5801 through 5802" after the existing cite "5508 through 5516."

Chapter 29. Effective with respect to goods entered or withdrawn from warehouse for consumption on or after January 10, 2002, Chapter 29 of the HTS is modified by:

moving the classification of "Paraldehyde, USP grade" to 2912.29.30, and deleting 2932.99.80 where it was formerly classified.

Deleting from the description of 2932.99.13 the product "3-Quinuclidinol," redesignating such subheading as 2933.99.12, then inserting a new 2933.99.15 for "Quinuclidin-3-ol" at the same column 1 general rate of duty. The USTR also states that 2933.99.12 and 2933.99.15 shall be subject to the Singapore FTA staged reductions previously proclaimed by the President for 2933.99.13.

Section 201 additional duties for steel. The USTR's notice makes certain modifications to U.S. Note 11 to Subchapter III of Chapter 99, for various effective dates, regarding subdivision (c)(cxcvi). U.S. Note 11 appeared in earlier versions of the HTS, but is not contained in the 2004 HTS (as these Section 201 steel duties are no longer in effect).

Chapter 99 for Chile FTA. Effective with respect to goods entered or withdrawn from warehouse for consumption on or after January 1, 2004, the following changes are made with respect to certain Chile FTA goods:

Revised U.S. Note 12(b). U.S. Note 12(b) to Subchapter XI of Chapter 99 is modified by amending the final paragraph to read: "Beginning in calendar year 2015, the aggregate quantity of originating goods of Chile entered under HTS 9911.17.05 in any calendar year shall be the quantity of goods equal to the amount of Chile's trade surplus in subdivision (a) of this note."

(The above-modified paragraph had previously stated: "Beginning in calendar year 2015, quantitative limitations on the aggregate quantity of goods of Chile's trade surplus entered under HTS 9911.17.05 shall cease to apply on such originating goods of Chile.")

Typographical errors in HTS 9911. Certain errors are corrected in the following HTS numbers with respect to Chile:

  1. 1.96.29
  2. 1.96.44
  3. 1.96.63
  4. 1.96.68
  5. 1.96.73
  6. 1.97.24

The errors being corrected in the above-listed HTS numbers appear to be typographical in nature. For example, some of the corrections consist of replacing "$2.025/kg" with "$2.025/kg" or deleting "$1.236kg" and inserting in its place " $1.236/kg", etc.

Subscribers should note that in the USTR's notice, 2933.99.15 appears to be erroneously listed as 2933.39.15.
