CITA Denies AGOA, ATPDEA, and CBTPA "Commercial Availability" Petitions for Apparel Made from Certain Fusible Interlining Fabrics
On March 26, 2004, the Committee for the Implementation of Textile Agreements (CITA) published two notices denying two petitions submitted by Levi Strauss and Co. which had alleged that certain fusible interlining fabrics classified under HTS 5903.90.2500 could not be supplied by the domestic industry in commercial quantities in a timely manner.

According to CITA, Levi Strauss and Co. had requested quota- and duty-free treatment under the African Growth and Opportunity Act (AGOA), the Andean Trade Promotion and Drug Eradication Act (ATPDEA), and the U.S.-Caribbean Basin Trade Partnership Act (CBTPA) for apparel articles that are both cut and sewn in one or more beneficiary countries utilizing such fabrics.
Based on currently available information, CITA states that it has determined that there is domestic capacity to supply a substitutable product for such fabrics in commercial quantities in a timely manner.
As a result of CITA's denial, apparel made from such fabrics that are not formed in the U.S. or in one or more AGOA, ATPDEA, or CBTPA beneficiary countries will not be eligible for quota- and duty-free treatment under the AGOA (HTS 9819.11.24), the CBTPA (HTS 9820.11.27), and/or the ATPDEA (HTS 9821.11.10).
