CBP Announces New HTS Provisions Effective April 1, 2004 for Certain Men's and Boys' Cotton T-Shirts, Etc

U.S. Customs and Border Protection (CBP) is announcing that effective April 1, 2004 there will be changes to the Harmonized Tariff Schedule (HTS) numbers at the statistical suffix level (the 9th and 10th digits) for certain men's and boys' cotton T-shirts and certain other garments classified in HTS 6109.10.00.

Specifically:

HTS 6109.10.0005 will be replaced by 6109.10.0004 (and will newly include V-necks), & HTS 6109.10.0009 will be replaced by 6109.10.0011 (and will only be for thermal undershirts).

The category number of these four tariff numbers (new and old) is the same, category 352.

In addition, the term "Underwear" will no longer appear above 6109.10.0004, and the indentation for "T-shirts..", "Singlets", and "Thermal undershirts" will be equal to the indent for "Other" appearing above 6109.10.0012.

The new tariff numbers (and HTS 6109.10.0007, which is unchanged) are expected to read as follows:

Of cotton
Men's or boys':
04 T-shirts, all white, short hemmed sleeves, hemmed bottom, crew or round neckline, or V- neck, with a mitered seam at the center of the V, without pocket, trim or embroidery (352)doz.kg.
07 Singlets, all white, without pockets, trim, or embroidery (352)doz.kg.
11 Thermal undershirts (352)doz.kg.

BP Notes
  1. Due to this change, government sources indicate that colored men's and boys' T-shirts (e.g. black, gray, pastel T-shirts) that prior to April 1, 2004 fall under HTS 6109.10.0009 (352) will fall under HTS 6109.10.0012 (Men's) or HTS 6109.10.0014 (Boys') (both 338) on and after April 1, 2004.
  2. Government sources believe that this change from category 352 to category 338 for such colored T-shirts will not significantly impact the trade.

In addition, government sources do not know if the CBTPA Tariff Preference Level (TPL) for non-underwear T-shirts (now that such colored T-shirts will be "non-underwear") would be impacted by this change.

  1. According to ITC sources, the Harmonized Tariff Schedule (HTS) is expected to be updated with this April 1, 2004 change (as well as other changes and corrections) sometime during the first few weeks of April 2004.
