CV: Canada Certain Softwood Lumber Products

(a) These companies as both exporter and producer have de minimis CV rates (Boccam: 0.41% and Sechoirs: 0.60%) and are excluded from the CV duty order.

(b) Indian River as both exporter and producer has an AD rate of zero and is excluded from the CV duty order.

(c) In addition to waiving CV cash deposit requirements for entries that have a time of entry on or after March 9, 2004, the ITA will also instruct CBP to refund all cash deposits of estimated CV duties already collected. (Note that liquidation is still suspended pursuant to the antidumping (AD) duty order on subject merchandise.)

(d) Companies other than the 28 listed above, will either be subject to an earlier final results of a CV duty review or the "all others" rate established in the original CV duty investigation. (The ITA notes that the "all others" rate is expected to changed in a future final results of a CV duty expedited reviews.) Rescission and Reinstatement of CV Duty Expedited Reviews

The ITA states that it is rescinding the CV duty expedited review with respect to Westcan Rail Ltd., and reinstating the CV duty expedited review with respect to Goldwood Industries Ltd.

Group 1 consists of companies that obtain the majority of their wood (over 50% of their inputs) from the U.S., the Maritime Provinces, Canadian private lands, and Canadian companies excluded from the order; as well as companies that source less than a majority of their wood from these sources and do not have tenure.

Group 2 consists of companies that source less than a majority of their wood from these sources and have acquired Crown timber through their own tenure contracts.
