AD: Brazil Industrial Nitrocellulose

The International Trade Administration (ITA) has initiated a changed circumstances antidumping (AD) duty review to consider revoking the AD duty order on industrial nitrocellulose from Brazil, due to a December 31, 2003 request to revoke the order by Nitro Quimica Brasileira (Nitro Quimica), a Brazilian exporter of subject merchandise and an interested party in this proceeding.

Consideration of Request to Revoke AD Duty Order

According to the ITA, Nitro Quimica states that no domestic producer of industrial nitrocellulose currently exists; therefore, revocation of the AD duty order is warranted due to the lack of interest on behalf of the U.S. industry.

Specifically, Nitro Quimica asserts that Hercules Incorporated, the only petitioner in the original investigation and the only U.S. producer at the time in which the AD duty order was issued, sold its nitrocellulose business to Green Tree Chemical Technologies (Green Tree) on June 16, 2001. Nitro Quimica further stated that Green Tree closed its U.S. production facility on about November 26, 2003.

The ITA states that Nitro Quimica believes the effective date of revocation should be retroactive to the date on which Green Tree ceased its U.S. production.

The ITA states that while this AD duty changed circumstances review is underway, the current requirement for a cash deposit of estimated AD duties on all subject merchandise will continue unless and until it is modified pursuant to the final results of this AD duty changed circumstances review.
