According to CBP, the PEA test allows importers to amend entry summaries (not informal entries) prior to liquidation by filing with CBP either an individual amendment letter upon discovery of an error or a quarterly tracking report covering any errors that occurred during the quarter.
PEA Test to Continue to Operate in Accordance with Previous General Notices
CBP states that the PEA test will continue to operate in accordance with the general notice it published in the Federal Register on November 28, 2000, as modified by a general notice published in the Federal Register on February 20, 2003. (See ITT's Online Archives or 11/30/00 news, 00112936, for BP summary of CBP's November 28, 2000 notice. See ITT's Online Archives or 02/24/03 news, 03022405, for BP summary of CBP's February 20, 2003 notice.)
CBP notes that the November 28, 2000 general notice, as modified by the February 20, 2003 general notice, describes how to file PEAs for revenue related errors and non-revenue related errors and the consequences of misconduct by importers during the test. CBP states that there are no application procedures or eligibility requirements to participate in the PEA test, and that an importer need only follow the procedure for making a PEA set forth in these notices.
Changes to PEA Test to be Announced in Due Course
According to CBP, comments received in response to the previously published general notices have been reviewed and CBP continues to evaluate the PEA test. Changes to the test based on the comments and the evaluation will be announced in the Federal Register in due course. CBP states that the test may be further extended if warranted.
