DOT Withdraws Advance Notice of Proposed Rulemaking on Maintenance of Intermodal Container Chassis and Trailers
The Department of Transportation's (DOT's) Federal Motor Carrier Safety Administration (FMCSA) has withdrawn a February 17, 1999 advance notice of proposed rulemaking (ANPR) relating to responsibilities for the inspection, repair, and maintenance of intermodal container chassis and trailers.

(On February 17, 1999, the DOT's Federal Highway Administration (FHWA) issued an advance notice of proposed rulemaking regarding any potential changes for the maintenance of intermodal container chassis and trailers. Included in this notice were proposed revisions to 49 CFR Parts 390 and 396 submitted by the American Trucking Associations, Inc. (ATA) and the ATA Intermodal Conference (petitioners), to mandate joint responsibility between the equipment provider and the motor carrier for maintaining intermodal container chassis and trailers.
In that notice, FHWA stated that the petitioners argued that poor maintenance of intermodal equipment is a serious safety problem and requested that FHWA make the owner or operator of such equipment responsible for the roadworthiness of the vehicles it tenders to motor carriers.)
Data Limitations Prevent FMCSA from Proceeding with Rulemaking Process
FMCSA states that after reviewing comments submitted through a number of channels and a final report, it has determined that it would be inappropriate to move forward with a proposed rule at this time. (See notice for details.)
