BIS Issues Interim Final Rule on Obtaining Authorization to Submit CWCR Declarations and Reports Electronically
The Bureau of Industry and Security (BIS) has issued an interim final rule, effective January 16, 2004, which amends the Chemical Weapons Convention Regulations (CWCR) in 15 CFR Part 711 by adding instructions on how to obtain authorization from BIS to make electronic submissions of declarations and reports required under the CWCR through the Web-Data Entry System for Industry (Web-DESI), etc.

According to BIS, the CWCR include requirements to report certain activities involving Scheduled chemicals and Unscheduled Discrete Organic Chemicals, and to provide access for on-site verification by international inspectors of certain facilities and locations in the U.S. (See ITT's Online Archives or 01/07/00 news, 00010641, for BP summary of the interim rule establishing the CWCR.)
Electronic Submission of CWCR Declarations and Report is Optional
BIS' interim final rule adds a new 15 CFR 711.7 entitled, "How to request authorization from BIS to make electronic submissions of declarations or reports." According to 15 CFR 711.7(a), this new section provides an optional method of submitting declarations or reports required under the CWCR. BIS notes that all such electronic submissions must be made through Web-DESI, which can be accessed on the CWC web site at www.cwc.gov.
In addition, this interim final rule also establishes procedures for the assignment and use of passwords for facilities, plant sites, and trading companies (USC password) and procedures for the assignment and use of Web-DESI use accounts (user name and password).
