AD: China Bulk Aspirin

The International Trade Administration (ITA) is amending its antidumping (AD) duty order, as well as its final and amended final affirmative AD duty determinations, on bulk aspirin from China as there is now a final court decision regarding this investigation.

Amendment to AD Duty Orde

As a result of the final court decision and the ITA's subsequent remand determination, Jilin Pharmaceutical (Jilin)1 will be excluded from the AD duty order on subject merchandise from China, because the court found its AD rate to be de minimis (1.27%).

The remand determination also resulted in an AD rate for Shandong Xinhua Pharmaceutical Factory, Ltd. (Shandong) of 6.42% (from 16.51%); however, ITA sources state that this margin does not change the current zero AD cash deposit rate for Shandong, which is based on the final results of an AD administrative review for a more recent time period. The ITA adds that the China-wide AD rate is not affected by the remand determination.

Appraisement Instructions, Instructions for Jilin

The ITA states that it will issue appraisement instructions directly to U.S. Customs and Border Protection (CBP). The ITA will instruct CBP to liquidate entries from Jilin, without regard to AD duties, as Jilin is excluded from the AD order effective September 30, 2002, the date on which the ITA published a notice of court decision.
