CBP Posts New TSN ACE User Requirement Recommendations; ACE EDI Message Drafts

U.S. Customs and Border Protection (CBP) has recently posted to its Web site certain new Trade Support Network (TSN) committee Automated Commercial Environment (ACE) user requirement recommendations and ACE Electronic Data Interchange (EDI) message drafts.

Updated TSN Account Management Requirement Recommendations

The TSN has recently updated (as of December 19, 2003) its ACE account management requirement recommendations in order to include one for the Broker Designation Flag.

Broker Designation Flag. The recommendation for the Broker Designation Flag states that ACE will notify the CBP Account Manager and/or Account Administrator and the Trade Account Owner, by either sending a message or flagging the transaction, when an unauthorized Customs Broker/Filer conducts Customs business on their behalf. Unauthorized Customs Broker/Filer is defined as the importer not having granted a Power of Attorney to the broker/filer to conduct Customs business on their behalf. Thus, the broker/filer is not listed in the importer's account as a designated broker.

The recommendation notes that the benefits of this requirement include: the trade can notify CBP if a Customhouse broker is violating CBP regulations and CBP has not denied the right of entry; CBP will be able to do trend analysis to verify whether the filer continually files entries for importers without having a valid Power of Attorney; and the importer will increase compliance through better control by monitoring, in real time, which entities are filing on their behalf.

The TSN has also recently updated (as of December 17, 2003) its ACE export requirement recommendations in order to add the following:

ACE EDI Message Drafts

In addition, CBP has posted to its Web site the following ACE EDI Message Drafts:

New/Modified EDI Messages for ACE Release 4 - Truck Manifest (updated as of December 8, 2003)

MEDPID EDI Message for Crew, Conveyance, and Equipment (updated as of December 12, 2003)

According to CBP, these types of EDI messages are being released as an initial advisory to the trade of the anticipated messages to be used in future releases of ACE. CBP notes that these messages may be supplemented, augmented and/or modified over time as conditions dictate.
