AD: Netherlands Certain Hot-Rolled Carbon Steel Flat Products

The International Trade Administration (ITA) has issued a notice amending its antidumping (AD) duty order on certain hot-rolled carbon steel flat products from Netherlands in order to terminate suspension of liquidation and AD duty liability for subject merchandise with a time of entry on or after October 30, 2001 (180 days from the date of publication of the preliminary determination) through November 28, 2001 (the day before the AD duty order was published).

Discontinuation of Suspension of Liquidation, AD Duty Liability For Certain 2001 Entries

The ITA states that the AD duty order inadvertently omitted the proper language to cease provisional measures (i.e. discontinue suspension of liquidation and AD cash deposit/bond requirements) six months after the publication of the preliminary determination, pursuant to 19 USC 1673b(d), and there is now a final and conclusive court decision on this issue.

As a result, the ITA states that it will issue instructions to U.S. Customs and Border Protection (CBP) to terminate suspension of liquidation, without regard to AD duties (i.e. release all bonds and refund all AD cash deposits) for entries of subject merchandise with a time of entry on or after October 30, 2001 through November 28, 2001.

The ITA also states that it will instruct CBP to continue suspension of liquidation on or after November 29, 2001 at the AD cash deposit rates currently in effect.
