The European Union (EU) is requesting World Trade Organization (WTO) authorization to apply retaliatory sanctions against the U.S. for its failure to bring the Continued Dumping and Subsidy Offset Act of 2000 (Byrd Amendment) into conformity with WTO rules by December 27, 2003. The EU states that this deadline for compliance with the WTO Appellate Body's ruling passed without action from U.S. Congress to repeal the measure.
CBP CROSS Rulings
CBP issues binding advance rulings in connection with the importation of merchandise into the United States. They issue the rulings to give the trade community transparency of how CBP will treat a prospective import or carrier transaction. Common rulings include the tariff classification, country of origin, or free trade agreement applicability of merchandise, among other things. These rulings are available in CBP's Customs Rulings Online Search System (CROSS) database.

CBP states that it is also proposing to revoke any treatment it has previously accorded to substantially identical transactions that are contrary to its position in this notice.

The Journal of Commerce (JoC) has reported that the Supreme Court has agreed to decide whether Mexican trucks should be subject to environmental reviews before being allowed to travel on U.S. roads. According to JoC, such trucks have been unable to operate in the U.S. because of a ruling by the 9th U.S. Circuit Court of Appeals that environmental reviews must be completed before the trucks are allowed into the U.S. (JoC 12/22/03 - 01/04/04, www.joc.com)

U.S. Customs and Border Protection (CBP) has issued an ABI administrative message which clarifies its previously issued instructions on the Special Bill programming (new non-vessel operating common carrier (NVOCC) and Master vessel operating common carrier (VOCC) bill types) for Sea Automated Manifest System (AMS) which was moved into production during the normally scheduled system outage on 11:00 p.m. EST Saturday, January 10, 2004 to 3:00 a.m. EST Sunday, January 11, 2004.
On October 18, 2003 the Bureau of Census (Census) implemented a final rule to, among other things, amend 15 CFR 30.7 to require the Employer Identification Number (EIN) or Social Security Number (SSN) of the duly authorized forwarding or other agent (if any) of a principal party in interest to be on the paper Shipper's Export Declaration (SED, Form 7525-V).
