CBP released its Nov. 18 Customs Bulletin (Vol. 49, No. 46) (here). While it does not contain any rulings, it does include recent CBP notices and Court of International Trade decisions.
CBP issued a final rule (here) that brings most of the agency's Freedom of Information Act regulations in line with the Department of Homeland Security, which CBP is a part of. "With the exception of a regulation pertaining to the treatment of confidential commercial information, CBP will apply the DHS FOIA and Privacy Act regulations for purposes of administering the FOIA," it said. The DHS FOIA regulations "reflect many Congressional amendments to the FOIA, for which conforming changes had not been made in the CBP FOIA regulations," it said. Although CBP generally already follows the DHS FOIA regulations, CBP hopes the regulatory changes will resolve confusion for public making FOIA requests, it said.
CBP said it created Harmonized System Update (HSU) 1509 on Nov. 16, containing 22,076 ABI records and 3,618 harmonized tariff records. The update includes annual special program staged rate reductions, said CBP (here). Adjustments required for the verification of the 2015 Harmonized Tariff Schedule are also included, CBP said in a CSMS message. The Customs Rulings Online Search System (CROSS) was updated Nov. 5 (here) with 48 rulings. The most recent ruling is dated 11/05/15.
CBP extended the comment period to Dec. 14 on an existing information collection for cargo container and road vehicle certification for transport under Customs seal. CBP proposes (here) to extend the expiration date of this information collection without a change to the burden hours or information collected.
CBP New York/Newark released statistics in a pipeline notice showing the "cycle time measurement" of Centralized Examination Stations from July through September. The cycle times refer to the time from ocean container arrival, as transmitted via the Automated Commercial Environment, through final examination completion release date.
Tablets containing Acyclovir, a pharmaceutical product active against herpes viruses, are produced in China and India, said CBP in a final determination published Nov. 13 (here). The Acyclovir is manufactured in China and India and goes through additional manufacturing in the U.S, said CBP. "The Acyclovir retains its chemical and physical properties and is merely put into a dosage form and is packaged for sale" while in the U.S, said CBP. As a result, "no substantial transformation occurs in U.S., and for purposes of government procurement, the Acyclovir tablets would be considered a product where the active ingredient was produced, which would be China and India," it said.
