The International Trade Administration issued its final affirmative antidumping duty determination on high pressure steel cylinders from China (A-570-977), which increases the AD rates for all respondents and the China-wide Entity. This final determination, which is effective May 7, 2012, is expected to be implemented by U.S. Customs and Border Protection soon.
The Food Safety and Inspection Service is proposing to remove sodium benzoate, sodium propionate, and benzoic acid from the list of substances that the regulations prohibit for use in meat or poultry products. Under this proposal, new uses of these substances in meat or poultry products would continue to be approved by the Food and Drug Administration for safety and by FSIS for suitability, and FSIS would add approved uses of these substances to the list of approved substances contained in the Agency’s directive system.

The International Trade Administration said Under Secretary Francisco Sánchez will lead an energy efficiency trade mission to Russia June 4-7, 2012. The U.S. delegation will include a senior U.S. Department of Energy official and representatives from 13 U.S. firms that offer a broad range of technologies to improve energy efficiency (see press release for list of firms).

The Court of International Trade granted domestic plaintiff Home Products International, Inc.’s (HPI) motion for reconsideration of its January 2012 ruling that sustained part of the final results of the International Trade Administration’s 2007-08 administrative review of the antidumping duty order on floor-standing, metal-top ironing tables and certain parts thereof (A-570-888). CIT conceded that it “did not fully grasp HPI’s argument” against the ITA’s decision to value respondent Since Hardware (Guangzhou) Co., Ltd.’s carton input using market economy prices. After fully understanding HPI’s argument, CIT remanded the determination to the ITA for further explanation.

The U.S.-China Economic and Security Review Commission announced a hearing on May 10, 2012, in Washington, D.C. This hearing, the USCC's fifth during its 2012 report cycle to collect input from academic, industry, and government experts on national security implications of the U.S. bilateral trade and economic relationship with China, will address China’s innovation capabilities, with emphasis on the information technology and defense sectors. Written statements are due from interested parties by May 9, 2012. Reservations are not required to attend the hearing.
The International Trade Commission is publishing notices in the May 4, 2012, Federal Register on the following AD/CV injury, Section 337 patent, and other trade proceedings (any notices that warrant a more detailed summary will appear in another ITT article):
The International Trade Commission issued a general exclusion order prohibiting the unlicensed entry of ground fault circuit interrupters and products containing the same that infringe certain claims of the ’809 patent (337-TA-739). The ITC further determined that a bond of $0.25 per unit is required to permit temporary importation of these products during the 60-day Presidential review period of the exclusion order. ITC has also issued cease and desist orders against certain named respondents.1 The ITC said these orders terminate the investigation2.
