The Animal and Plant Health Inspection Service announced changes May 29 to Plant Protection and Quarantine (PPQ) electronic manuals. While some changes are minor, other changes may affect the admissibility of the plant products, including fruits, vegetables, and flowers.

The Court of International Trade sustained a Commerce Department scope ruling that found Power Train Components’ wheel hub units are covered by the scope of the antidumping duty order on tapered roller bearings from China (A-570-601). CIT agreed with the agency that the wheel hub units without antilock braking (ABS) sensors are covered by the scope language addressing “tapered roller housings … whether or not for automotive use.” In support, the court noted that the ITC injury report from the investigation identified wheel hub units as a type of tapered roller bearing, and depictions of wheel hub units were included in the original petition. The court then looked at Commerce’s determination that Power Train’s wheel hub units incorporating ABS sensors are within the scope, and found Commerce’s analysis of each of the 19 CFR 351.225(k)(2) factors -- physical characteristics, expectations of ultimate purchasers, ultimate use, channels of trade, and manner of display and advertising -- to be reasonable.

Nokia filed a complaint May 23 requesting the International Trade Commission block imports of several models of HTC cellphones that purportedly infringe its patents. According to Nokia, infringing models include the HTC One S, One V, One X, Evo 4G LTE, Droid Incredible 4G LTE, Droid DNA, One X+, One VX, First, and One. Nokia is requesting cease and desist and limited exclusion orders barring imports of the cellphones. It also requests the limited exclusion order block imports of components of the infringing cellphones, such as chipsets, to prevent evasion of any import ban.
The Commerce Department issued the preliminary results of its antidumping duty new shipper review on multilayered wood flooring from China (A-570-970), calculating a preliminary zero AD rate for merchandise produced by Guangzhou Homebon Timber Manufacturing Co., Ltd. and exported by Power Dekor Group Co., Ltd. If the agency continues to find a zero AD rate in the final results, it will instruct CBP to liquidate entries of subject merchandise produced by Homebon and exported by Power Dekor during the period of review without regard to AD duties, and not collect cash deposits on such entries. These preliminary results are not in effect. Commerce may modify them in the final results of this review and change the estimated AD cash deposit rate for this company.

The Food and Drug Administration finalized its requirement that prior notice submissions for imported food name any countries where the food shipment has been refused entry. The final rule adopts a May 2011 interim rule, without change, amending 21 CFR 1.281 (see 11050516). The requirement has been in effect since July 3, 2011, as required by Section 304 of the Food Safety Modernization Act.
