Court of Appeals for the Federal Circuit Chief Judge Randall Rader is resigning from his position of Chief Judge effective May 30, he announced at an event held by the Federal Circuit Bar Association on May 23 (here). He will be replaced as chief judge by Sharon Prost, said CAFC (here). Rader’s resignation was followed by an apology for ethical breaches related to his interaction with an attorney in a patent case. He will remain active on the court.

The Fish and Wildlife Service is amending its regulations on importation and exportation of endangered species, in a final rule that takes effect June 26. The final rule mostly adopts unchanged a proposed rule issued in March 2012 (see 12031423). Revisions include revised definitions for coral, cultivar, and sturgeon caviar; revised labeling and tagging for elephant ivory, vicuna, fur, and sturgeon caviar; processing changes for CITES documents, changes to how some CITES specimens may be used after import, etc.
The Commerce Department is postponing until July 24 the preliminary determination in its antidumping duty investigations on crystalline silicon photovoltaic products from China (A-570-010) and Taiwan (A-583-853). The agency’s preliminary findings were originally due June 11, but Commerce says the investigation is “extraordinarily complicated.” Cash deposits of estimated AD duties may be required beginning on the date of Commerce’s preliminary determination, and in certain circumstances cash deposit requirements may be made retroactive 90 days before the agency’s preliminary finding.
A countervailing duty cash deposit requirement will take effect May 27 for imports of calcium hypochlorite from China (C-570-009), as the Commerce Department found illegal subsidization of Chinese producers in its preliminary determination. The agency assigned a CV duty cash deposit rate of 71.72 percent for all exporters of the pool cleaning chemical.
The Commerce Department will require antidumping duty cash deposits on imports of 1,1,1,2-tetrafluoroethane from China, it said in an May 22 fact sheet. The agency found AD duty rates of 133.47% to 327.33% for Chinese companies in its preliminary determination. The final determination in this investigation is currently due in October. ITT will have more details on the preliminary rates when Commerce publishes its preliminary determination in the Federal Register.
