A World Trade Organization dispute settlement panel found some aspects of China’s requirements for electronic payment services to be inconsistent with its WTO obligations in the panel’s report in China — Certain Measures Affecting Electronic Payment Services (DS413). While the panel said there was not enough evidence to establish that UnionPay maintains an across-the-board monopoly over provision of electronic payment services, it said UnionPay does maintain a monopoly in certain situations that violates China’s market access commitments. The panel also said, among other things, that requirements that all payment cards bear the UnionPay label violates national treatment obligations.

Laos has completed all its bilateral negotiations and is close to completing its multilateral membership package for accession to the World Trade Organization, the WTO said. It is on track to complete the talks soon after the August WTO summer break and its membership is to be approved formally before the end of the year, the WTO working party of delegations negotiating the membership bid was told at a July 12 meeting. According to the WTO, Laos would like the General Council to approve its membership before Vientiane hosts the Asia-Europe summit meeting in early November.
The International Trade Commission released its report entitled “Trade Facilitation in the East African Community: Recent Developments and Potential Benefits.” The report is based on empirical studies and the experiences of other developing countries, ITC said. According to the report, trade is growing rapidly among EAC member countries, and many African countries, including EAC members, have taken steps to facilitate trade, such as the simplification of customs procedures and improvements to transport infrastructure. The International Trade Commission released its report entitled “Recent Trends in U.S. Services Trade, 2012 Annual Report.” The report presents a statistical overview of U.S. trade in services and highlights some of the service sectors and geographic markets that contribute substantially to recent services trade performance.
The International Trade Commission is publishing notices in the July 13 Federal Register on the following AD/CV injury, Section 337 patent, and other trade proceedings (any notices that warrant a more detailed summary will appear in another ITT article):
An Administrative Law Judge issued an initial determination July 12 finding no violation of complainant Freescale’s Section 337 patent claims by MediaTek and Zoran in the International Trade Commission’s investigation of certain integrated circuits, chipsets, and products containing same including televisions (337-TA-786). Funai, the other respondent, had already been terminated from the investigation on the basis of a consent order. The ALJ found that, among other things, no industry exists in the U.S. that exploits the patent at issue. The full Commission will now decide whether to review the ALJ’s initial determination.

The International Trade Administration issued the preliminary results of its administrative review of the antidumping duty order on chlorinated isocyanurates from China (A-570-898) for four companies. These preliminary results are not in effect. The ITA may modify them in the final results of this review and change the estimated AD cash deposit rate for these companies.
