Commerce Sets New AD on Hydrofluorocarbon Blend R-410B From Turkey
New antidumping duties take effect retroactive to July 7, 2023, for importers of certain hydrofluorocarbon blends from Turkey, the Commerce Department said in its preliminary determination in an anti-circumvention inquiry.

Commerce preliminarily found imports of R–410B from Turkey made from China-origin HFC components and further processed in the U.S. are circumventing the AD order on hydrofluorocarbon blends from China (A-570-028). Suspension of liquidation and cash deposit requirements take effect on the date Commerce published its initiation notices that began the inquiries (see 2307060063).
Commerce will establish a certification scheme for importers of hydrofluorocarbon blends from Turkey to establish that their imports weren't made with Chinese inputs, and shouldn’t be subject to AD. The Turkish company Cantas won’t be eligible to use the certifications because of its non-cooperation with the anti-circumvention inquiry, Commerce said.
For entries on or after July 7, 2023, of R–410B from Turkey made from China-origin HFC components and further processed in the U.S., Commerce will require cash deposits at the 216.37% China-wide rate for the AD order on hydrofluorocarbon blends from China.
"If an importer imports R–410B from Turkey and claims that it was not produced using China-origin HFC components and/or not further processed into subject merchandise in the United States, in order to not be subject to the Order cash deposit requirements, the importer and exporter are required to meet the certification and documentation requirements," Commerce said.
Certifications are due April 22 for entries between July 7, 2023, and March 7, 2024, with a blanket option available covering multiple entries. Importers of R-410B from Turkey must file post-summary corrections with CBP for any entries declared as non-AD that are now covered by retroactive suspension of liquidation and cash deposit requirements, Commerce said.
