Section 232 Tariffs on Aluminum From Canada Continue Despite USTR Announcement
Duties continue to be collected under the Section 232 tariffs on aluminum from Canada, despite a September Office of the U.S. Trade Representative announcement that the tariffs would end. Lauren Wilk, Aluminum Association vice president for policy and international trade, said Oct. 22 that a presidential proclamation or executive order rolling back the tariffs never came.

“Presumably, if the EO is signed, the duties paid since September 1 would be refunded -- and then there would be some kind of future determination when the trade data is publicly available each month (through the end of this year) about retroactively collecting duties,” she said. “But in the absence of the proclamation, many of the mechanics are still unclear.”
On Sept. 15, the day Canada was planning to retaliate for the return of 10% tariffs on 7601.10 aluminum, or unalloyed unwrought aluminum, the USTR said the tariffs would be rolled back (see 2009150048). The USTR said then that those duties would only be imposed if quantities exceeded certain volumes each month. CBP didn't immediately comment.
