BIS Seeks Comments on Additional Questions for Export Monitoring & Controls on Recyclable Metallic Materials Containing Copper
The Bureau of Industry and Security (BIS) has posted to its Web site a list of additional questions it is seeking comments on in connection with a petition it received requesting the imposition of export monitoring and export controls on copper scrap and copper-alloy scrap. This is the second list of questions issued by BIS regarding this request, the first set of questions appeared in BIS' original Federal Register notice announcing receipt of the petition.

BIS states that the commodities to be considered in this proceeding, identified by Schedule B number, are 7404.00.0020, 7404.00.0045, 7404.00.0062, and 7404.00.0080.
(BIS explains that under the provisions of 7(c) of the Export Administration Act of 1979 (EAA), as amended and as implemented by 15 CFR 754.7, certain entities that process metallic materials capable of being recycled may file a petition with BIS requesting that the Department of Commerce impose monitoring on the export of such material, controls on the export of such material, or both, in order to carry out the policy set forth in section 3(2)(C) of the EAA.)
Responses to Second Set of Questions are Also Due by 5:00 p.m. on June 7, 2004
According to BIS sources, comments for interested parties in response to BIS' list of additional questions are due by 5:00 p.m. on June 7, 2004, the same deadline for comments in response to the questions listed in BIS' original Federal Register notice. The additional questions fall under such topics as industry identification, supply and demand considerations, scrap wholesaler/exporter considerations, etc.
In addition to comments, BIS scheduled a public hearing for May 19 (which could possibly have continued on May 20, 2004), in connection with this proceeding.
